Terms of Service

1. Acceptance of Terms

By accessing or using the Safeliant Evidence Guard platform, website (safeliant.com), APIs, or related services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you are using the Service on behalf of an organisation, you represent and warrant that you have the authority to bind that organisation to these Terms.

If you do not agree to these Terms, you must not access or use the Service. These Terms constitute a legally binding agreement between you (“Customer”, “you”, “your”) and Safeliant (“Company”, “we”, “us”, “our”).

2. Service Description

Safeliant provides automated consent compliance monitoring, evidence capture, and reporting infrastructure (the “Evidence Guard” service). The Service includes:

  • Automated scanning and analysis of website consent implementations.
  • Capture and storage of consent evidence records with deterministic scoring.
  • Generation of audit-ready PDF evidence packs and compliance reports.
  • Email authentication monitoring (SPF, DKIM, DMARC) via Inbox Shield.
  • API access for integration with your compliance workflows.
  • Dashboard and reporting tools for managing compliance data.

The Service does not provide legal advice. Safeliant provides evidence infrastructure and compliance monitoring tools. You are responsible for interpreting results and consulting qualified legal counsel regarding your compliance obligations. See our Disclaimer for full details.

3. Account Registration

To use the Service, you must create an account by providing accurate, complete, and current information. You agree to:

  • Provide truthful and accurate account information and keep it up to date.
  • Maintain the security and confidentiality of your account credentials, API keys, and access tokens.
  • Immediately notify us at security@safeliant.com of any unauthorised use of your account or any security breach.
  • Accept responsibility for all activity that occurs under your account.

Safeliant reserves the right to suspend or terminate accounts that contain inaccurate information or that are used in violation of these Terms.

4. Acceptable Use

Your use of the Service is subject to our Acceptable Use Policy, which is incorporated into these Terms by reference. Key requirements include:

  • You may only scan domains and websites that you own or have explicit, documented authorisation to monitor.
  • You must not use the Service to generate false, misleading, or fraudulent compliance evidence.
  • You must not attempt to reverse-engineer, circumvent security measures, or interfere with the Service's operation.
  • You must not exceed published API rate limits or implement automated workarounds to bypass usage restrictions.

Violation of the Acceptable Use Policy may result in immediate suspension or termination of your account.

5. Subscription Plans and Pricing

5.1 Plans

The Service is offered under various subscription plans with different feature sets, scan limits, and retention periods. Current plans and pricing are available on our website. Safeliant reserves the right to modify plans and pricing at any time, with at least 30 days' notice for existing customers.

5.2 Free Trial

New accounts may include a 14-day free trial with access to paid features. At the end of the trial period, you must subscribe to a paid plan to continue using paid features. We will not charge you automatically at the end of the trial without your explicit consent.

5.3 Billing

  • Paid plans are billed monthly or annually, as selected at the time of subscription.
  • All fees are quoted in USD and are exclusive of applicable taxes unless stated otherwise.
  • Payments are processed securely through Stripe. By subscribing, you agree to Stripe's terms of service.
  • Failed payments will be retried according to Stripe's retry schedule. After repeated failures, your account may be downgraded or suspended.

5.4 Refunds

Subscription fees are non-refundable except where required by applicable law. If you believe you are entitled to a refund, contact us at support@safeliant.com and we will review your request on a case-by-case basis.

6. Cancellation

You may cancel your subscription at any time through your account settings or by contacting support. Upon cancellation:

  • Your subscription remains active until the end of the current billing period.
  • You retain access to all paid features until the billing period expires.
  • Your data remains available for export for 30 days after the subscription ends.
  • After the 30-day export period, your data will be deleted in accordance with our Data Processing Agreement.

7. Intellectual Property

7.1 Safeliant's IP

The Service, including all software, algorithms, scoring methodologies, rulepacks, documentation, branding, and content, is owned by Safeliant and protected by intellectual property laws. These Terms do not grant you any ownership rights in the Service.

7.2 Your Data

You retain all rights to the data you submit to the Service. By using the Service, you grant Safeliant a limited, non-exclusive licence to process your data solely for the purpose of providing the Service. We do not use your data for any other purpose without your consent.

7.3 Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant Safeliant a non-exclusive, royalty-free, perpetual licence to use such feedback to improve the Service without any obligation to you.

8. Data Protection and Privacy

Our processing of personal data is governed by our Privacy Policy and, where applicable, our Data Processing Agreement. By using the Service, you acknowledge and agree to the data practices described in those documents.

We use cookies and similar technologies as described in our Cookie Policy.

9. Service Level and Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable advance notice. Current service status is available at our Status page.

We reserve the right to modify, update, or discontinue features of the Service at any time. We will provide reasonable notice of material changes that affect your use of the Service.

10. Limitation of Liability

To the fullest extent permitted by applicable law:

  • Safeliant provides evidence infrastructure and does not guarantee compliance with any regulation. You are solely responsible for acting on findings and consulting legal counsel as needed.
  • Safeliant shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, business opportunities, or goodwill.
  • Safeliant's total aggregate liability for any claims arising from or related to the Service shall not exceed the total fees paid by you in the 12 months preceding the claim.
  • Safeliant is not liable for regulatory fines, penalties, or enforcement actions resulting from your compliance programme, regardless of whether you used the Service.

11. Indemnification

You agree to indemnify, defend, and hold harmless Safeliant and its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from:

  • Your use or misuse of the Service.
  • Your violation of these Terms or the Acceptable Use Policy.
  • Your violation of any applicable law or regulation.
  • Scanning of websites without proper authorisation.
  • Any claim that your use of the Service infringed a third party's rights.

12. Termination

12.1 Termination by You

You may terminate your account at any time by cancelling your subscription and requesting account deletion through your account settings or by contacting support.

12.2 Termination by Safeliant

Safeliant may suspend or terminate your account immediately and without prior notice if:

  • You breach these Terms or the Acceptable Use Policy.
  • Your use of the Service poses a security risk or may cause harm to other users.
  • We are required to do so by law or regulatory order.
  • Your account has been inactive for more than 12 consecutive months.

12.3 Effect of Termination

Upon termination, your right to access the Service ceases immediately. Data retention and deletion follow the terms of our Data Processing Agreement. Provisions that by their nature should survive termination (including intellectual property, limitation of liability, and indemnification) shall continue in force.

13. Dispute Resolution

Any disputes arising from or related to these Terms shall first be addressed through good-faith negotiation between the parties. If a dispute cannot be resolved through negotiation within 30 days, it shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration body, unless you are entitled to bring claims in a court of competent jurisdiction under applicable consumer protection laws.

14. Governing Law

These Terms are governed by and construed in accordance with applicable law. Nothing in these Terms shall limit your rights under mandatory consumer protection legislation in your jurisdiction.

15. Changes to These Terms

We may update these Terms from time to time. When we make material changes:

  • We will update the “Last updated” date at the top of this page.
  • We will notify registered users by email or in-app notification at least 30 days before the changes take effect.
  • Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
  • If you do not agree to the revised Terms, you must stop using the Service and cancel your account.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with the Privacy Policy, Data Processing Agreement, Acceptable Use Policy, Cookie Policy, and Disclaimer, constitute the entire agreement between you and Safeliant with respect to the Service and supersede all prior agreements, understandings, and communications.
