Acceptable Use Policy

1. Purpose
This Acceptable Use Policy (“AUP”) sets out the rules and restrictions that govern your use of the Safeliant Evidence Guard platform, APIs, and related services (collectively, the “Service”). This AUP is incorporated into and forms part of the Terms of Service. Capitalised terms not defined herein have the meanings given in the Terms of Service.
By accessing or using the Service, you agree to comply with this AUP. Violation of this AUP may result in suspension or termination of your account without prior notice or refund.
2. Authorised Use
You may use the Service only for the following lawful purposes:
- Scanning and monitoring websites, domains, and digital properties that you own or for which you have obtained explicit, documented authorisation from the owner.
- Capturing, storing, and reviewing consent evidence records for GDPR Article 7 compliance purposes or equivalent regulatory requirements.
- Generating compliance scores, evidence packs, and audit-ready reports for your own internal compliance and audit processes.
- Integrating the Service into your compliance workflows via the provided APIs and documented interfaces.
- Exporting your evidence data in supported formats for use with your legal, compliance, or data protection functions.
3. Prohibited Conduct
You shall not, and shall not permit any third party to, engage in any of the following activities in connection with the Service:
3.1 Unauthorised Scanning & Access
- Scanning, crawling, or monitoring websites, domains, or digital properties that you do not own and for which you have not obtained explicit written authorisation.
- Using the Service to gain unauthorised access to any computer system, network, or data.
- Circumventing, disabling, or interfering with any access controls, authentication mechanisms, or security features of third-party websites or the Service itself.
- Scanning websites behind paywalls, login gates, or access restrictions without proper authorisation from the website owner.
3.2 Abuse & Misuse
- Using the Service to harass, threaten, stalk, or intimidate any person or entity.
- Using the Service to generate false, misleading, or fraudulent compliance evidence or reports.
- Fabricating, altering, or tampering with evidence records, timestamps, IP addresses, or any other data captured by the Service.
- Using the Service for competitive intelligence gathering, data scraping, or any purpose unrelated to compliance monitoring.
- Submitting URLs or content that is illegal, harmful, defamatory, obscene, or otherwise objectionable.
- Using the Service to collect personal data of individuals for purposes other than legitimate compliance monitoring.
3.3 Technical Abuse
- Attempting to reverse-engineer, decompile, disassemble, or otherwise derive the source code of the Service or any component thereof.
- Introducing malicious code, viruses, trojans, worms, or any other harmful software or data into the Service.
- Interfering with or disrupting the integrity, performance, or availability of the Service or its infrastructure.
- Exceeding published API rate limits or implementing automated processes designed to circumvent usage restrictions.
- Using the Service to conduct denial-of-service attacks, load testing, or stress testing against any third-party system.
- Attempting to access accounts, data, or systems belonging to other Safeliant customers.
- Sharing, distributing, or exposing API keys, access tokens, or account credentials to unauthorised parties.
- Automating account creation or using the Service through bots or scripts not authorised by Safeliant.
3.4 Legal & Regulatory Violations
- Using the Service in violation of any applicable local, national, or international law or regulation, including but not limited to data protection laws (GDPR, CCPA/CPRA, LGPD), computer fraud and abuse laws, and export control regulations.
- Using the Service to process, store, or transmit data subject to specific regulatory frameworks (e.g., HIPAA, PCI-DSS) unless expressly agreed with Safeliant in writing.
- Using the Service to facilitate or conceal money laundering, terrorist financing, or sanctions evasion.
- Violating the intellectual property, privacy, or other rights of any third party.
3.5 Resale & Redistribution
- Reselling, sublicensing, or redistributing access to the Service without Safeliant's prior written consent.
- Offering the Service as part of a competing product or repackaging Safeliant's output as your own product.
- Using the Service to build or train a competing service, product, or technology.
- Removing, altering, or obscuring any proprietary notices, branding, or attribution from the Service's outputs.
4. Rate Limits & Fair Use
To ensure service quality and availability for all customers, Safeliant enforces rate limits and fair-use thresholds on API calls, scan requests, and report generation. These limits are documented in your subscription plan and the API documentation.
- You must not attempt to circumvent, exceed, or automate workarounds for published rate limits.
- Safeliant reserves the right to throttle, suspend, or restrict access to accounts that exhibit usage patterns materially exceeding their plan's allocated resources or that degrade service performance for other customers.
- If your legitimate use requires higher limits, contact us to discuss an appropriate plan upgrade or custom arrangement.
5. Content Responsibility
You are solely responsible for all URLs, data, and content you submit to the Service. Safeliant does not pre-screen or monitor submitted content but reserves the right to review, remove, or refuse to process any content that violates this AUP.
You represent and warrant that you have all necessary rights, permissions, and authorisations to submit content to the Service and that such content does not infringe the rights of any third party.
6. Security & Credential Management
- You are responsible for maintaining the confidentiality and security of your account credentials, API keys, and access tokens.
- You must promptly notify Safeliant at security@safeliant.com of any suspected or actual unauthorised access to your account.
- You must implement reasonable security measures when integrating with the Service, including secure storage of API keys, use of HTTPS for all communications, and appropriate access controls within your organisation.
- Safeliant is not liable for any loss or damage arising from your failure to safeguard your credentials.
7. Monitoring & Enforcement
Safeliant reserves the right, but has no obligation, to monitor use of the Service for compliance with this AUP. We may investigate any suspected violation and take any action we deem appropriate, including:
- Issuing a warning to the account holder.
- Temporarily suspending access to all or part of the Service.
- Permanently terminating the account without refund.
- Removing or disabling access to content that violates this AUP.
- Reporting the activity to relevant law enforcement or regulatory authorities.
- Taking legal action to recover losses and enforce this AUP.
Safeliant will endeavour to provide notice before taking enforcement action where practicable, but reserves the right to act without prior notice in cases of serious or ongoing violations, or where delay could result in harm to Safeliant, its customers, or third parties.
8. Reporting Violations
If you become aware of any violation of this AUP, whether by yourself, your users, or any third party, you must promptly notify Safeliant at abuse@safeliant.com. All reports will be investigated and treated confidentially to the extent possible.
9. Consequences of Violation
Violation of this AUP may result in one or more of the following consequences, at Safeliant's sole discretion:
- Immediate suspension or termination of your account and access to the Service.
- Forfeiture of any prepaid fees for the remainder of the billing period.
- Liability for any damages suffered by Safeliant, its customers, or third parties as a result of the violation.
- Referral to law enforcement or regulatory authorities where the violation constitutes a criminal offence or regulatory breach.
These remedies are in addition to, and not in substitution for, any other rights and remedies available to Safeliant under the Terms of Service, at law, or in equity.
10. Changes to This Policy
Safeliant may update this AUP from time to time to reflect changes in our services, legal requirements, or industry best practices. We will notify you of material changes by posting the updated AUP on our website and, where appropriate, by email notification. Continued use of the Service after the effective date of any changes constitutes your acceptance of the revised AUP.
