To the fullest extent permitted by applicable law, Safeliant disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, reliability, and availability.
2. No Legal Advice
Safeliant does not provide legal advice. The Service is an evidence infrastructure tool that captures, scores, and reports on consent compliance indicators. Nothing in the Service, on our website, in our documentation, blog posts, marketing materials, or communications constitutes legal advice, a legal opinion, or a recommendation to take or refrain from any action.
Compliance scores, evidence reports, and assessments generated by the Service are based on automated, deterministic analysis of publicly available website data against predefined rulesets. These outputs are informational tools designed to assist your compliance programme — they are not, and should not be interpreted as, legal determinations of compliance or non-compliance with any law, regulation, or standard.
You must consult with qualified legal counsel regarding your specific compliance obligations under GDPR, ePrivacy Directive, CCPA/CPRA, or any other applicable data protection legislation. Reliance on the Service's outputs without independent legal review is at your own risk.

- Compliance scores reflect the actual legal compliance status of any website, form, or digital property.
- The Service identifies all consent compliance issues on any scanned property.
- The absence of detected issues constitutes compliance with any regulation.
Regulatory requirements are complex, jurisdiction-specific, and subject to change. The Service is a tool to support your compliance efforts, not a substitute for a comprehensive data protection programme overseen by qualified professionals.
4. Accuracy of Information
While we strive to ensure the accuracy and completeness of all information provided through the Service, we make no warranties or representations regarding:
- The accuracy, completeness, or timeliness of scan results, evidence records, or compliance scores.
- The availability or accessibility of third-party websites submitted for scanning.
- The correctness of our interpretation of website elements, consent mechanisms, or cookie implementations.
- The completeness of page snapshots, screenshots, or HTML captures, which may be affected by dynamic content loading, JavaScript rendering, or network conditions.
Scanned data reflects the state of the target website at the specific moment of capture. Websites are dynamic; content may change at any time before or after scanning.

The Service may capture, display, or reference content from third-party websites as part of its evidence collection functionality. Safeliant does not endorse, control, or assume responsibility for the accuracy, legality, or content of any third-party website, service, or material.
Our website may contain links to third-party websites for informational purposes. These links do not imply endorsement or affiliation. We are not responsible for the content, privacy practices, or availability of linked third-party sites. Accessing third-party websites is at your own risk and subject to those sites' own terms and policies.
6. Service Availability
We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. 7. Limitation of Liability

- Any damages arising from the use or inability to use the Service, reliance on compliance scores, or evidence reports.
- Any damages arising from unauthorised access to or alteration of your data or transmissions.
These limitations apply whether the alleged liability is based on contract, tort (including negligence), strict liability, or any other legal theory, even if Safeliant has been advised of the possibility of such damages. In jurisdictions that do not allow the exclusion or limitation of certain damages, our liability shall be limited to the maximum extent permitted by applicable law.
8. Indemnification
You agree to indemnify, defend, and hold harmless Safeliant and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:
- Your use or misuse of the Service.
- Your violation of these disclaimers, the Terms of Service, or the Acceptable Use Policy.
- Your violation of any applicable law, regulation, or rights of a third party.

9. Scoring Methodology Disclaimer
The compliance scores generated by Evidence Guard are based on a deterministic, penalty-based scoring system that evaluates publicly observable compliance indicators against versioned rulesets. Specifically:
- Scores start at 100 and are reduced based on detected issues classified as Critical (-15), High (-8), Medium (-4), or Low (-1).
- Status thresholds (Green: 90-100, Yellow: 70-89, Red: 0-69) are arbitrary benchmarks and do not correspond to any legal standard of compliance.
- Rulesets are developed by Safeliant based on our interpretation of regulatory guidance and industry best practices — they are not endorsed by any regulatory authority.
- A high score does not mean you are compliant. A low score does not necessarily mean you are non-compliant.
- Scoring criteria and methodologies may change between rulepack versions.
10. Evidence Record Disclaimer
Evidence Records generated by the Service capture a snapshot of website conditions at a specific point in time. Important limitations:
- Evidence Records reflect what was publicly accessible and observable at the time of the scan. They may not capture dynamically loaded content, content behind authentication, or elements requiring user interaction.
- Safeliant does not guarantee that Evidence Records will be admissible as evidence in any legal proceeding, arbitration, or regulatory investigation.
- The evidentiary weight and admissibility of any output is determined by the applicable legal forum and governing law, not by Safeliant.
- While Evidence Records include integrity hashes for tamper detection, these are technical measures — their legal significance is determined by the relevant jurisdiction.
11. Blog & Educational Content
Blog posts, guides, tutorials, and other educational content published on safeliant.com are provided for general informational purposes only. Such content may reflect the author's views at the time of publication and may become outdated as laws, regulations, and best practices evolve. This content does not constitute legal advice, and you should not act or refrain from acting based solely on such content.
12. Governing Law
This Disclaimer is governed by and construed in accordance with the laws applicable to the Terms of Service. Any disputes arising from or related to this Disclaimer shall be resolved in accordance with the dispute resolution provisions in the Terms of Service.
